Abstract The legislature passed ESSB 5223, “Mental Health Advance Directives,” during the 2003 Legislative Session.  This act establishes the right of individuals to create mental health advance directives. Section 25 of the legislation also states that should a resident of a long-term care facility be admitted to an inpatient psychiatric hospital based on a mental health advance directive, the long-term care facility must accept the resident for readmission on the same basis as if the inpatient admission had been for a physical condition.  ESSB 5223 also directs the Joint Legislative Audit and Review Committee (JLARC) to conduct this evaluation of the operation and impact of this portion of the legislation.
